BlackBuck: Appeal Dismissed, ₹22.42 Crore Tax Demand Upheld

BlackBuck Limited announced that its appeal against an adjudication order concerning input tax credit has been dismissed by the Joint Commissioner of Commercial Taxes (Appeals). This decision upholds the original order, confirming a total demand of ₹22,42,28,783, which includes tax, interest, and penalty. The company is evaluating further appeal options.

Appeal Dismissed by Tax Authorities

BlackBuck Limited has disclosed that its appeal against a prior adjudication order related to input tax credit has been dismissed. The order dated July 28, 2026, from the Joint Commissioner of Commercial Taxes (Appeals)-4, Bengaluru, upheld the original demand raised by the Assistant Commissioner of Commercial Taxes.

Confirmation of Tax Demand

The initial order, dated February 24, 2025, had confirmed the reversal of input tax credit for the tax period April 2020 to March 2021. The dismissal of the appeal means the total demand of ₹22,42,28,783 now stands confirmed. This amount comprises tax of ₹10,01,02,136, interest of ₹11,41,16,435 up to the order date, and a penalty of ₹1,00,10,212. The company had already deposited ₹1,00,10,214 as pre-deposit and ₹1,35,550 as admitted tax and penalty.

Reasons for Reversal and Appeal

The original order cited non-disclosure of input tax credit pertaining to FY 2019-20 in annual returns, ITC attributable to supplier credit notes and non-compliance with Section 16(2)(c), and certain invoices not appearing in GSTR-2A as grounds for reversal. BlackBuck had filed an appeal after making the mandatory pre-deposit.

Future Course of Action

The company has taken the latest order on record and is currently evaluating the possibility of filing a further appeal before the GST Appellate Tribunal (GSTAT). This decision will be made once the tribunal is constituted, and within the prescribed time limits under the relevant CGST/KGST Act, 2017.
