Siemens: Supreme Court Dismisses GST Appeal, Concludes Major Tax Litigation

Siemens Limited has announced the conclusion of a significant Goods and Services Tax (GST) litigation. The Hon’ble Supreme Court has dismissed a Special Leave Petition (SLP) filed by the GST Department, challenging a previous order from the Gujarat High Court. This dismissal effectively quashes a proposed GST levy of ₹34.83 crore, along with applicable interest and penalties, related to the assignment of the company’s leasehold interest in a property in Halol, Gujarat. The company had initially received a show cause notice in this regard.

Litigation Concluded in Favour of Siemens

Siemens Limited has successfully concluded a major tax litigation matter. The company announced that the Hon’ble Supreme Court has dismissed a Special Leave Petition (SLP) filed by the GST Department. This development follows an earlier order by the Hon’ble Gujarat High Court, which had quashed a show cause notice issued to Siemens regarding a proposed GST levy. The original notice, dated 20th September, 2025, proposed a GST amount of ₹34,83,00,000/-, plus interest and penalties, in relation to the transfer and assignment of the company’s leasehold interest in a property located at Halol, Gujarat. The Gujarat High Court’s decision favouring Siemens was initially reported by the company on 27th November, 2025.

Supreme Court Dismisses GST Department’s Appeal

The GST Department subsequently filed an SLP before the Hon’ble Supreme Court, seeking to challenge the Gujarat High Court’s ruling. However, the Supreme Court’s decision to dismiss this petition means the litigation has now officially concluded, with the outcome being entirely in favour of Siemens Limited. The order from the Supreme Court was received by the company on 20th August, 2026, at approximately 3:30 p.m.
