Honasa Consumer: Dubai Court Upholds Arbitral Award, Dismisses Appeals

Honasa Consumer Limited announced that the Cassation Court in Dubai has dismissed appeals filed by both parties in the ongoing litigation with RSM General Trading LLC. The Cassation Court upheld a previous judgment awarding RSM approximately AED 1,707,407.06. However, Honasa noted an earlier Arbitral Tribunal award favoring the company, which enjoins RSM from initiating further proceedings in Dubai courts, leading Honasa to expect no financial impact.

Dubai Cassation Court Ruling

Honasa Consumer Limited has disclosed a significant development in its ongoing litigation with RSM General Trading LLC in Dubai. The Cassation Court of Dubai has issued a judgment on July 29, 2026, which dismisses the appeals filed by both Honasa Consumer and RSM. This ruling upholds the judgment previously passed by the Court of Appeals on February 11, 2026.

Previous Award and Company Expectation

The Court of Appeals had awarded RSM an amount of AED 1,707,407.06 (approximately INR 4,43,12,369) as compensation for material and moral damages. It is noted that RSM had initially sought damages to the tune of AED 45,000,000, which was rejected by the Cassation Court. Crucially, Honasa Consumer highlighted that an Arbitral Tribunal, appointed by the Supreme Court of India, had previously issued an Arbitral Award on May 14, 2025, as amended on June 26, 2026. This award favored Honasa, permanently enjoining RSM from initiating proceedings in Dubai courts and requiring RSM to pay damages to Honasa. Given these reliefs, Honasa Consumer expects no financial impact from the Dubai court proceedings.

Governing Law and Jurisdiction

The company also clarified that, under the Civil Procedure Code of 1908, the Cassation Court’s judgment may not be conclusive or binding due to the governing law of the agreement being Indian law and disputes subject to arbitration or the exclusive jurisdiction of New Delhi courts.
