Laxmi Organic Industries Faces Regulatory Appeal from MSEDCL to APTEL Over MERC Order

Laxmi Organic Industries has confirmed that Maharashtra State Electricity Distribution Company Limited (MSEDCL) has filed an appeal against the company and the Maharashtra Electricity Regulatory Commission (MERC). The appeal challenges a favorable Final Order issued by MERC on September 17, 2025. MSEDCL seeks to overturn the order at the Appellate Tribunal for Electricity (APTEL) in New Delhi, though the appeal’s admission is pending a hearing on MSEDCL’s delay condonation application.

Regulatory Litigation Update

Laxmi Organic Industries Limited has disclosed the initiation of new legal proceedings against the company. The Appellant, Maharashtra State Electricity Distribution Company Limited (MSEDCL), has filed an appeal before the Appellate Tribunal for Electricity (APTEL) in New Delhi. The opposing party is Laxmi Organic Industries Limited, with the Maharashtra Electricity Regulatory Commission (MERC) also named as a Respondent.

Details of the Dispute

The core of the dispute revolves around the Final Order passed by MERC in Case No. 137 of 2025 on September 17, 2025, which was issued in favor of Laxmi Organic Industries. MSEDCL is challenging this Final Order. It is noted that MSEDCL’s appeal (Case No: DFR No. 89 of 2026) was filed with an application seeking condonation of delay of 116 days, which has not yet been admitted by APTEL. The tribunal will only proceed with the appeal if it allows this condonation application.

Potential Financial Exposure

While the company asserts that the appeal is not sustainable, having already been technically examined by MERC, potential financial implications have been quantified. If APTEL admits the appeal and grants a stay on the operation of the Final Order, Laxmi Organic Industries could be exposed to a maximum potential financial impact of approximately ₹407.27 million, plus any applicable interest.

Litigation Status

As the matter is currently pending admission by APTEL, the details concerning the conclusion of the litigation, any change in status, or any potential settlement terms are currently marked as Not Applicable.
