JSW Energy Limited Supreme Court Upholds Ruling on Generation Based Incentive (GBI) Payments

Resolution of Long-Standing Legal Dispute

JSW Energy Limited provided an update regarding material litigation that dates back to an earlier disclosure on September 30, 2023. The dispute centered on a writ petition filed by the Indian Wind Power Association, of which JSW Neo Energy Limited (a subsidiary) is a member.

The core issue involved an order from the Andhra Pradesh Electricity Regulatory Commission (APERC) dated July 28, 2018. This initial order permitted Andhra Pradesh DISCOMs to deduct the Generation Based Incentive (“GBI”) from payments due for energy supplied by the subsidiary.

Supreme Court’s Final Verdict

In concurrent proceedings, the Hon’ble Supreme Court delivered its judgment on March 25, 2026. The Court dismissed the appeal filed by the Andhra Pradesh DISCOMs against the decision of the Appellate Tribunal for Electricity.

Crucially, the Supreme Court affirmed that the GBI is intended to be disbursed to the generating companies over and above the tariff. This favorable ruling resolves the legal challenge concerning GBI deductions, benefiting JSW Neo Energy Limited’s subsidiaries.
