Waaree Energies Clarifies U.S. Customs Determination on Solar Module Imports

Waaree Energies Limited has issued a media statement clarifying a recent determination by U.S. Customs and Border Protection (CBP) regarding its solar module imports. The company emphasized that CBP confirmed Waaree did not export modules made with Chinese-origin solar cells and fully cooperated with the investigation. Waaree has the right to seek administrative and judicial review of the determination, which is limited to a narrow subset of historical entries, and its U.S. business operations remain unaffected.

Waaree Energies Addresses U.S. Customs Determination

Waaree Energies Limited has released a media statement to clarify recent reports concerning a determination issued by the U.S. Customs and Border Protection (CBP) in EAPA Consolidated Investigation No. 8163. The company highlighted that following a comprehensive investigation, including an on-site verification of its manufacturing facility in India, CBP expressly confirmed key findings.

Key Findings from CBP Investigation

According to Waaree, CBP confirmed that the company:

  • Did not export solar modules manufactured using Chinese-origin solar cells to the United States.
  • Fully cooperated throughout the investigation process.
  • Was not subject to any adverse inference by CBP.
  • Saw CBP decline the petitioner’s request for an evasion finding covering all of Waaree’s imports.

It was further stated that CBP’s determination is restricted to a narrow subset of certain historical import entries and is not considered a final adjudication. Waaree retains the right to pursue a de novo administrative review and subsequent judicial review before the U.S. Court of International Trade, and is currently assessing all available legal remedies with its U.S. trade counsel.
