The court has directed MSEDCL to provide an interim payment of ₹250 crores to the company. Additionally, the court has requested that the Appellate Tribunal for Electricity (APTEL) re-hear the interim stay application filed by MSEDCL concerning the previously favorable order passed by the electricity commission.

Following a legal challenge filed by MSEDCL against an earlier favorable order, the Hon’ble Supreme Court issued a directive on April 30, 2026. This order mandates that MSEDCL must immediately disburse ₹250 crores as an interim payment to JSW Energy. This decision serves as a significant development in the ongoing litigation regarding tariff payments for the company’s Ratnagiri unit.
Background of the Dispute
The conflict originated from a dispute over the applicability of Section 11 directives issued by the Central Government. In a previous ruling dated December 24, 2025, the electricity commission had rejected MSEDCL’s contentions and ordered the utility to pay tariffs in accordance with the Power Purchase Agreement dated February 23, 2010, including applicable Late Payment Surcharges.

As part of the Supreme Court’s disposition, the court has instructed the Appellate Tribunal for Electricity (APTEL) to re-evaluate the interim application previously filed by MSEDCL. This re-hearing will address the utility’s request to stay the earlier order that had favored the company.
